It was embarrassing because the bods at Arsenal basically misunderstood what a release clause meant and got caught out with their own **** up.

They believed that the release clause meant that 40m was the minimum a club should offer such that the player's contract would be terminated and then it would be up to Suarez. They didnt realise that's not how it works and the selling club could still say no... so when Liverpool did say no, they looked like complete amateurs.

At the time it was reported that the £40m release fee was in the contract and should have triggered a release clause, but that the John Henry simply refused to honour it, and knew that there was no precedent in court to see it through.

I thought the £40,000,000 +1 was a stupid of us at the time though as that was always going to piss them off. We should have offered £45m-£50m

It's very much a continental thing. The realease clause is usually there to ward off rivals BUT many clubs often agree to sell at a lower fee. Arsenal thought they could do the same and initially offered 35m iirc. When Liverpool said no, Arsenal thought **** it, ok we'll trigger the release clause with the 40m +£1 bid bcos the player wants to come to us. But they were mistaken as the selling club still have the final say. That's always been the case tbh.

 

The contract is always going win out and whichever club has the signature of the player holds all the cards. It would have been interesting if Arsenal had taken the issue to court to test the clause, as if the contract is worth the paper it's written on then the clause should have held if tested in a court of law, but it would have needed to have set a legal precedent as I don't think a case has been heard before. As for what they do on the continent, it might sound cliched, but a lot of rules are basically made up as they go along, in local government, council, planning, etc. I would imagine football is even worse.

 

That's the misconception though. All that clause is, is an agreement from the player that he accepts his club will only consider a minimum sum for selling him. In no way does it mean the club HAS to sell. It's purely for the club's benefit and that is all.

The club can even choose to waive it if they think it's worth it, which is why I quoted continental clubs. They do it all the time. Think we did it with Herrera.
