    The relevance is, that you're arguing for the sake of it, you don't actually believe it will be settled by ACAS any more than I do.

    Chazz is right that you have to involve ACAS before an ET (I was wrong)
    OLM is right that it will be a token gesture and Gosschalks will be instructed to go to ET

    I could replace ACAS

    That isn't what was said and you know it. I'm arguing, you completely ****ed it up.
    You were wrong when you implied I didn't know what I was talking about when I said it had to go through acas.
    You were wrong when you said it's a waste of time, early conciliation deals with a hell of a lot of cases without .A tribunal. They do an excellent job. Rather dismissive of you.
    I have no idea if it will be settled before the tribunal and neither do you.

    Again it's not a token gesture and it's a dismissive comment of an excellent service.
    Tribunals don't like having frivolous cases, not saying this is before olm posts more ****, they will not be happy if it could have been sorted by acas and may be more agreeable to a side with a cast iron case.

    I didn't mean to be dismissive of ACAS
    I'm sure they do great work, I've had little involvement with them and I know you have so are much more knowledgeable about them

    I was meaning that I expect the club's engagement with them will be a token gesture. I could be wrong, but they don't seem to have a history of being conciliatory do they?

    I still think an ET is on the cards because even though I know nothing about the case, What I do know is that there are plenty of frivolous cases lodged at a tribunal, and often done so that the employer settles prior to the hearing because it will cost them less than their costs to fight it

    Ye i dont think it will go to tribunal. It will be settled on the eve of it, probably.
    Its for both sides to have a look if they have a good case. No employer, probably, ever goes err actually ye... at this stage. But a lot of workers do as its anger at being sacked kicks off the claim.

    They wont get their jobs back but will get 6 months or a years wages out of it. Unless they really have them bang to rights. And remembering the state of the pitch against Swansea and him too busy sorting FC's kit out straight after the Fc game instead of sorting the pitch, they might. Whether thats enough, and i doubt they will have enough hard evidence but rather by the way sort of stuff of attitude, lateness, doing FC work when they should be doing the pitch.... Which can be twisted by the employer or can be difficult to prove even if true.
    I assume they were sacked without any pay off??

    They were sacked for Gross Misconduct, that requires a serious issue, attitude and lateness certainly isn't going cut it.

    They're acting under legal advice, from the employment division of one of the city's biggest law firms, they're no doubt confident of their case.

    I really don't know anything about this case, so no idea whether they got a pay off. I'd doubt it if it was gross misconduct

    Allam's might be more likely than most to go to tribunal though. No one tells them how to run their legal claims !

    Actually if it is such a good case why arent they doing it no win no fee????

    Strange to see the Trust jumping on this and supporting the pair of them.

    Do they ballot their members over stuff like this or is there a members forum it's discussed on to gauge feelings?
