With regard to Manager Joey Barton’s court appearance by video link this morning, the Club has been informed that the matter is proceeding to trial and is therefore sub judicial. Accordingly, the Club is unable to make any further comment other than to quote the Crown Prosecutor this morning who said “this is a victimless crime. No one has made a claim of assault”. Following the weekend’s publicity and today’s court appearance Joey is taking a few days personal time to be with his family. Clint Hill will therefore lead the team for tomorrow night’s friendly against Havant and Waterlooville.
The CPS made that statement about victimless crime? Just because his wife didn't make a complaint against him for assault doesn't mean there wasn't a victim and she wasn't assaulted.
I'd say that's a blatant misquote. The CPS wouldn't waste time and money is there was no assault and no victim.
It's a disgraceful quote because of the impression they've tried to give with their 'no victim' statement. Joey's wife doesn't want to give evidence which is usual for women in domestic abuse cases, so the term for that is 'victimless crime' when in the courts. She has still been assaulted and the CPS clearly think they've got enough evidence to prosecute even without her attending the court case. It's not 'victimless' - The victim just doesn't want to give evidence.
Do CPS call it victimless crime or have they said they have no complaint of assault and the rest is as suggested misquoted.
Victimless crime is the correct term in the courts so I'd have thought the prosecutor did say it. Not sure why it has to be like that, they should use a term such as 'case without victim evidence'
You'd think the witnesses will be the hosts or friends of the victim ... ... she was probably too frightened to report it herself.
