Midfielder Andy Shinnie was on loan from Luton from last October and has made 16 appearances. His contract with Luton ran to the end of this season but now Charlton have signed him on a permanent deal. This means they can now play him with their other 5 loanees in a match-day squad - leage rules say you can only name 5 on-loan players in a matchday squad. Considering the transfer window closed ages ago how come this is allowed? Its a loophole both clubs have exploited. Luton stop paying some of his wages and Charlton get an extra loanee slot. Cheeky, but not illegal.
Personally I think loans should be limited to only 3 or 4 months maximum, no more than 5 in a club in a season. Too many clubs rely on players they'll never be able to sign properly because they play is miles out of their league (pardon the pun), so they don't really build a team themselves.
In order to sign a free agent, that player needed to be a free agent before the transfer window closed
I don't know, if there was pre-agreement between any of the parties then it could be argued that cancellation of the players contract wasn't done in good faith because they colluded to get around the transfer window regulations. Alternatively it could be argued that there was a third party involved in the contract cancellation thus it wasn't exclusively by mutual consent and therefore is invalid.
He played for Charlton against Gillingham on Saturday just gone - Feb 13th. Doesn't the team sheet have to say if a player is on loan and from whom, to show the ref they are eligible to play in the game? If he was still on loan from Luton at that point, and you are correct about needing to be a free agent before the window closed, then this permanent signing has got to be illegal.
It looks like they have changed the loan contract terms into a permanent transfer deal. I don't know how that sits with the footballing authorities. https://the72.co.uk/223023/confirme...etic-mans-contract-means-addicks-can-exploit/
I’m sure that’s wrong as I heard that a player has to be a free agent before the window closes to be able to permanently sign fir another club.
I can’t find anything which says yes or no but it sticks in my head about a player we tried to sign but his contract hadn’t been cancelled before the deadline
The reason this is allowed is because it’s the registration of a player that can’t change during a non-transfer window, not the economic ownership. You can sign a player at any time. You just can’t register to play him until the next transfer window. The FA / FIFA can’t block clubs from transferring money to each other - that would be restriction of trade. All loanee players are registered to their loaned club for that period - such as Sanderson is currently registered for us. He can’t play for another club during this period, even his parent club. It’s why loanees can no longer be recalled by parent clubs outside of windows. So as he is already registered at Charlton, he is Charlton’s player during this period, and they can play him freely - whether as a loan player or an owned player. The restriction on how many loan players you can play, is around how many of those registered players do the club actually hold the economic rights to. So when Charlton formally “signed” his economic rights from his previous club, they didn’t actually need to change his registration, they just removed the “tag” which says they don’t own him. Hope I’ve explained that well enough to make sense
