So if that was the case someone assaulting someone would be just as well killing him, may as well be hung for a sheep as a lamb?
If you punished someone for attempted murder in the same way as you punished someone for actual murder, where is the disincentive to not just commit a murder instead of battering somone? You've knocked a guy unconcious with a hammer, why not just finish him off?
I dont know what you get up to up in "helensburgh" russ but when I think of assault I think of a punch to the face or something similar not bashing someone's head in with a hammer
might be serious assault. depends how many times you hit him and what state they were in after it if you repeatedly struck someone over the head with a hammer until they were KO'd then yes that would be attempted murder.
I would imagine that if you have just hit him numerous times to the head with a hammer, then the guy will be dead. By hitting someone with a hammer to the head, I would say even one strike should be classed as attempted murder. (Doesn't include inflatable hammers)
Fair point. A guy that took my football team when I was a kid got 6 months for hitting someone with a slater's hammer. Enough brain damage was done to victim so the dude spoke slowly and dribbled all the time. He was called Droopy in the local pubs.
Better to be safe than sorry though, no point in leaving a pesky witness lying around and if you do get caught, well what the hey, your getting life anyway whether or not you give him a final dint to the heid.

Ach to be honest I was just seeing how long I could argue over a point I don't really care that strongly about, it was quiet when I started now i'm juggling about a dozen conversations.
