It's Alternative Dispute Resolution. Part of the PL's own dispute resolution under rule x.26 of their own handbook. Both parties appoint an arbitration panel of three by agreement. Usually a top QC independent of both chairs the panel. Decisions at arbitration are legally binding. Their powers are limited by rule x.26. Decisions on legal questions or questions of fact are their remit. So, as an example, they can rule that PIF and the Saudi state are separate. That would be legally binding meaning an application under the ODT could only focus on named directors. Potential shadow directors such as MBS, would not come under scrutiny as they may be deemed to be part of the state and not acting directly in decision making relating to Newcastle United. This appears to be the main dispute. Piracy would of be an issue if PIF were deemed to be part of the state. If not, the named directors cannot possibly be said to have facilitated state sponsored piracy. They can assess whether the ODT has been applied fairly or decide if PL conduct has been unreasonable. So, if there is any hint that outside influences or subjectivity have come into play they can order the testvyo be applied correctly. They can also order payment of a sum of money. Even though their remit appears narrow, they can decide on matters that are part of the general legal system. So can rule on matters of company and contract law in relation to takeovers, tests and application of PL rules. They key is PL rules.

Yeah, I think I'm onside with it now. There's a lot of "coincidences". Luke Edwards, for example, publishing his article is suggesting a lot is happening. He's basically saying "I've been told it'll be done in Feb", without actually saying that (understandably, doesn't want to give false hope or just be wrong). Club seems like a ghost ship. Charnley simply isn't seen, though allegedly has been at games.
That says to me that NUFC has received assurances that is going through and now planning for the takeover. Skeleton staff and running. It may also explain Bruce's change of mood. He is like someone who knows he will soon be out of a job.
Well he has the look of someone under no pressure. He was after Sheff Utd, he was a mess, but after Arsenal he was calm and at times smiling. I even got the impression the "roll sleeves up" was done wryly. I initially thought that was bad news, Ashley acting far too late, Bruce getting assurances he didn't deserve, etc. Now I think, perhaps, it's that all of this is going to disappear, Bruce will get his pay-out, no longer his problem and he fades into relative obscurity with a few more million in the bank.
