    ..Fare-dodger assault man charged

A passenger who threw a suspected fare-dodger off a train in Scotland has been charged with assault, British Transport Police have said.

Alan Pollock nicknamed 'Big Man' is seen in viral mobile phone footage manhandling 19-year-old Sam Mains during an altercation between the Falkirk youth and the ticket inspector.

Mr Mains was then pushed head-first onto the platform - receiving cuts to his face and bruises.

British Transport Police said in a statement: "We can now confirm that a 35-year-old man from Stirling and a 19-year-old man from Falkirk are the subject of a report to the local Procurator Fiscal in connection with an incident on-board the 21:33 Edinburgh Waverley to Perth service, at Linlithgow on Friday 9 December 2011."

At first, the 'Big Man' was hailed a 'hero' by many for tackling Mr Mains, while others criticised his heavy-handed response.

Student Sam Mains also faces prosecution after he was reported under section 38 of the Criminal Justice and Licensing Act Scotland, which covers threatening and abusive behaviour, and with trespass. He has yet to be formally charged.

Many years ago I got a clip off the old police sergeant in Whitburn. Do I have a claim for police brutality?

This just justifies my wife and i decision not to have kids.
I really wouldn't want to bring kids into this world we live in now.

I hate sayin, when I was a boy, but things like this were thought of as being good, helping out, taking a stand. They wonder why people dont bother any more, they talk of old values but they dont back it up.

We are told every day that 'normal' people have to take a stand against anti-social behaviour. Agreed. The question you have to ask yourself here is "who was the most anti-social?"

I know where I sit, but there are so many do-gooders muddying waters.

Good the guy was twice the size of the lad I bet he wouldn't have done it if the lad was bigger the inspector should have called the transport police you can't be a vigilante

We are now very much a politically correct country. That's what happens when you go down that route.

The politicians are to blame for it.

Why should everyone be held up by this foul mouthed little toe rag, pity the train wasn't moving when the little T**t was thrown off. There are too many bloody do gooders now, which is why we live in a **** society.

From what i can gather though, The lad had 2 outbound tickets, there was a mix up with them, instead of getting 1 outbound and 1 inbound, he was lumbered with 2 outbound, and he didnt realise till he got on the train, tbh if i was him and it was my last train home i would have argued the toss as well, and i am 39 but just because this lad was a teenager he is a little toerag.

As for the "big man" he probably didnt know the full extent of what was happening, but the conductor said it was fine for him to get involved, and chuck him off the train, tbh the conductor should be having the book thrown at him, not the 2 ppl that all this is about imho.

True the train shouldn't of been held up but the guy should have not been assaulted as I said the Inspector should have phoned the transport police to deal with it.

I think you are right, most people would have "argued the toss" but without the foul mouthed abuse that the "toerag" is alleged to have used. Perhaps if he had been civil to the conductor the situation would not have developed as it did.

whatever the rights and wrong my point is that the intention was right so a word and even warning on the quiet, fait enough, a charge and court case, daft IMO

Just watched the video again he said "I have shown you my ****ing ticket", maybe not the smartest move in the book, but lets be honest, who doesnt swear, especially when you are under duress and its not your fault you have 2 outbound tickets (if that was indeed the case).

Pretty sure as well, the conductor would have stamped/put a hole in 1 of the tickets, on his outbound journey, if his other ticket wasnt stamped, then it doesnt take a brain surgeon to work out that there was indeed a mixup.

I still say the conductor is to blame for most of it.
