Not sure about the UK, but I am sure in the US that ANY evidence in even a criminal trial is inadmissible in court if obtained through illegal means. So Astro yes, if a stolen, illegally obtained video showed someone killing and murdering a victim, they would not be able to play it in court. They could however, force anyone who had watched the video, to testify as to its content, but they would not be able to show it.
Then tell Astro to stop talking ****e Just because he wants City to get nailed to the wall, it aint gonna happen.
It depends on the judge, but if a prosecutor had a video of a murder being committed he would allow it to be shown.
You have utterly made that up. The material evidence in a criminal case has domain over ownership. You are getting confused with the right of police to obtain evidence without a warrant. You really need to stop now.
So if somebody has a stolen video of someone else murdering somebody, you maintain that the evidence could not be shown in a criminal murder case if the police didn't have a warrant and permission of the accused to obtain it? Are you ****ed in the head? Apart from the fact that a warrant would be immediately forthcoming, I refer you to my burglar who finds a murdered body on someone else's property. And yes, before you say it, I know this is a civil case, but you were referring to Astro's criminal analogy. In a civil case, as explained, both parties have right to full disclosure - all Uefa has to do (if it hasn't been done already) is to ask City to disclose the original e-mails that were hacked. Give up.
Yes, in the US, as I stated that is exactly what would happen, if the prosecution tried to submit it as a exhibit it would be roundly rejected by the judge, and the police who obtained it would be indicted. And no, you dont need permission of the accused ya bell end.
Go on then, give me the example of a video that shows somebody murdering a victim that was inadmissible in court because it was obtained illegally.
Who said I was taking it to court, I just want some masturbatory material when i get bored of Pornhub
no it isn't, the court would admit the video as evidence. UEFA would/will get laughed out of a real court, if/when it gets there. CAS has no legal authority to see the emails at all.
