Since @ellandback asked nicely on our board I will give my answer - I say touchline ban because ultimately it is the FA's fault for not having the rule in place but still need to dish out a token slap on the wrist. Also it will be hilarious to see him sat on top of a bucket just behind the dugout and it making no impact whatsoever.

Not bothered, it’s a story about nothing but a man doing his job and gathering intel. Most of the intelligence he’s gathering is probably via watching games on DVD, man must be a workaholic. Pity our board when they went and interviewed him a few years ago didn’t employ him, if he had we would probably still be a PL club. The man had a dossier ready after watching our previous seasons games outlined strength and weeknesses plus where we needed to strengthen. Leeds have a good manager there, will you be able to hold onto him? I can see him taking you up automatically to the PL and good luck other than when we visit Elland Road. He's already managing Leeds. Isn't that punishment enough? Seriously though, he's not broken any rules and I assumed that everyone already did this. With the amount of money sloshing around in the Premier League, does anyone really believe that this is isolated to Bielsa? I expect that they're all at it.
It seems that Bielsa needs to chose his staff more carefully - if the person concerned hadn't been stupid enough to get caught, there wouldn't be a story. Have that person trained as a referee and then have him assigned to matches with youngsters - the abuse he'll get from over-competitive parents would be enough punishment.

Even when they do ban a spy standing outside the ground, teams will find other methods, just like other industries. Drone. Double agents. ( isn't that why a team sells players).
My vote is conditional. If no rules have been broken then no action should be taken. If rules HAVE been broken then a points deduction (typically 10-15 points) and a fine are the usual punishment - or banning promotion (like SWINDON in the 1990s).
