Mate you have to remember the other legal team is at play here also and they're not stupid..

They obviously feel they have a genuine chance of getting the CAT case thrown out.

They're taking that chance

 

Well not really. They need another 28 days to do so. That sounds to me like they are lifting pebbles on the beach in the hope of finding a Pearl.

 

It's anyone's guess, but I actually now believe that if the cat case isn't thrown out they'll fold...otherwise why are they so so desperate to keep things hidden?

 

So in effect the ARB is totally irrelevant.

 

No it's just a 50 /50 and as demarco says the main aim is it to not get that far.


Basically I believe the premier league will take a chance on arbitration if the cat case is thrown out because it's dirty dealings won't be exposed either way, but if the cat case isn't thrown out I believe they'll be forced to pass the takeover and won't go to arbitration.

Just my take on things but don't think I'm alone on that right now

They have been given 28 days to submit a jurisdiction response outlining why the case should be thrown out without the hearing of evidence.

The PL applied for access to an addendum to NUFC's statement of claim. This was refused. The PL's have argued that the issues under dispute are being dealt with under arbitration and so have argued a technicality I.e, that you cannot have a separate tribunal for the same dispute. However, the High Court in NUFC v PL suggested that the only matter for arbitration was separation of PIF and not a breach of competition law. If that position is correct then the CAT dispute concerns matters not before the arbitration panel.

Presumably that is NUFC's argument. That the dispute is wider and publicity is in the public interest.

Either way this takeover saga has been an absolute grueller.

 

If the PL's application is thrown out then expect a very speedy resolution.

As I said previously when one party tries to delay it is usually because their case is weak.

 

Well they can accuse us of many things....
